By accessing or using any of our Services, including but not limited to Advanced Time and Task Tracker, Asheville Annotator Tools, ThaliCam, Plant Health Check, Advanced Wisdom Vault Search ChatGPT, and Tutivsoft History Analyzer and Insights, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.
1. Use of Services
Eligibility: To use our Services, you must be at least 13 years old. By using the Services, you represent and warrant that you are of legal age to form a binding contract with Tutivsoft.
License: Subject to your compliance with these Terms, Tutivsoft grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for your personal and professional use.
Prohibited Conduct: You agree not to:
- Use the Services for any illegal or unauthorized purpose.
- Interfere with or disrupt the integrity or performance of the Services.
- Attempt to gain unauthorized access to our systems or data.

2. Accounts and Data

By submitting User Content, you grant Tutivsoft a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing the Services. For example, for Asheville Annotator Tools, this allows the application to process your documents to provide automated annotations.
3. Subscriptions and Payments
Certain Services, such as Advanced Time and Task Tracker or enhanced features within Asheville Annotator Tools, may require a paid subscription.
- Billing: You agree to pay all fees associated with your subscription. All payments are handled by the respective platform’s payment processor (e.g., Google Play, Microsoft Store).
- Automatic Renewal: Subscriptions may automatically renew unless you cancel them through the appropriate platform store. You are responsible for managing your subscription to avoid unwanted charges.
- Refunds: Tutivsoft’s refund policy is subject to the refund policies of Google Play and the Microsoft Store. We do not provide direct refunds.
4. Intellectual Property
All intellectual property rights in the Services and their original content, features, and functionality are and will remain the exclusive property of Tutivsoft and its licensors. The Services are protected by copyright, trademark, and other laws. Nothing in these Terms gives you a right to use the Tutivsoft name or any of the company’s trademarks, logos, or domain names.
5. Disclaimers and Limitation of Liability
“AS-IS” Basis: The Services are provided “as is” and “as available” without warranties of any kind, either express or implied. Tutivsoft does not warrant that the Services, including Advanced Time and Task Tracker, Asheville Annotator Tools, or ThaliCam, will be uninterrupted, error-free, or secure.
Limitation of Liability: To the maximum extent permitted by law, Tutivsoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any conduct or content of any third party on the Services; or (d) any errors or omissions in the Services.
6. General Provisions
Termination: We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including without limitation if you breach these Terms.
Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website or within the applications. Your continued use of the Services after such a notification constitutes your acceptance of the new Terms.
Governing Law: These Terms shall be governed by the laws of the jurisdiction where Tutivsoft is located, without regard to its conflict of law provisions.
